3. What this site is
This website exists to explain what we do, share what we know, and let you get in touch. Nothing on it is a binding offer of services. Any work we do together is governed by a separate written agreement, and if that agreement conflicts with these terms, that agreement wins.
4. The Fix Your 3 Leaks diagnostic
The diagnostic is a free self-assessment tool. It scores the answers you give and, where we can find your business, shows public information from your Google Business Profile.
It is an estimate, not an audit. Its output depends entirely on the accuracy of your answers. The Google data comes from Google's public API, may be incomplete or out of date, and sometimes we cannot match your business at all, in which case we say so rather than guess. Do not treat the results as a professional assessment of your marketing, and do not make significant business decisions on the strength of them alone.
5. No guaranteed results
Marketing outcomes depend on your market, your competition, your budget, your operations and factors outside anyone's control. Nothing on this site, including examples of past client work, is a promise or prediction of what you will achieve.
6. Content on this site
Articles, guides and other material here are general information, not professional advice for your specific situation. Verify anything you intend to act on.
7. What you send us
You keep ownership of anything you submit. By submitting it you give us permission to use it to respond to you and provide our services. Do not send anything unlawful, misleading, infringing, or that you do not have the right to share. We may remove comments or submissions at our discretion.
8. Our content
The text, design, graphics, logos and code on this site belong to HEARD Digital Marketing or our licensors. You may read and share it. You may not copy it wholesale, resell it, or present it as your own.
9. Acceptable use
Do not attempt to breach, disrupt, overload or reverse engineer the site, scrape it at scale, or use it to send unsolicited messages.
10. Third-party services and links
This site embeds and links to services we do not control, including Google, Vimeo and GoHighLevel. We are not responsible for their content, availability or practices.
11. Disclaimer
The site is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.
12. Limitation of liability
To the fullest extent permitted by law, HEARD Digital Marketing is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of this site. Our total liability for any claim relating to this site is limited to one hundred dollars.
13. Indemnity
You agree to indemnify and hold harmless HEARD Digital Marketing from claims arising out of your misuse of the site or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Colorado, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in Denver County, Colorado.
15. Changes
We may update these terms. Continued use of the site after changes means you accept them.
